By accessing or using the Nightlife Solutions platform ("Service"), operated by RG Gamma LLC, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Nightlife Solutions is a venue management platform that provides reservation management, guest list operations, host-guest communications, and related tools for nightlife businesses.

3. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information when creating an account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Send unsolicited or spam messages through the platform
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Upload malicious code or content
  • Violate any applicable laws or regulations, including TCPA and other communications laws

5. SMS Messaging

When using our SMS features, you agree to:

  • Only send messages to individuals who have consented to receive them
  • Comply with all applicable messaging laws (TCPA, CAN-SPAM, etc.)
  • Honor opt-out requests promptly
  • Not send messages containing prohibited content

You are solely responsible for the content of messages sent through the platform and for obtaining proper consent from recipients.

6. Guest Data

You are responsible for the accuracy and legality of any guest data you enter into the platform. You represent that you have the right to store and process such data and will comply with all applicable privacy laws.

7. Intellectual Property

The Service and its original content, features, and functionality are owned by RG Gamma LLC and are protected by copyright, trademark, and other intellectual property laws. Your data remains yours.

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, secure, or error-free.

9. Limitation of Liability

To the maximum extent permitted by law, RG Gamma LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

10. Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Continued use of the Service after changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law provisions.
